By accessing or using MontrealStays, you agree to be bound by the following Terms and Conditions. These terms apply to all users of the platform, including guests and hosts. Please read them carefully before making or accepting a booking.

Rates

Listing rates on MontrealStays are set by individual hosts and are not valid during blackout dates. Rates are displayed in Canadian dollars, calculated on a nightly basis, and apply to the number of occupants specified at the time of booking.

For stays of fewer than 31 nights, applicable provincial and municipal taxes will be added to the total. Tax rates may vary depending on the property location within Quebec.

Additional fees such as mandatory exit cleaning, parking, and platform service fees are displayed at checkout before booking confirmation. Rates are subject to change at the host’s discretion and are not guaranteed until a booking is confirmed.

All transactions on MontrealStays are processed in Canadian dollars. The following payment methods are accepted:

  • Credit card (Visa, MasterCard, AMEX)
  • Debit card
  • Bank transfer (where applicable)
  • Other payment methods made available through our payment processor

For secure payments, guests will be directed to a payment link processed via our payment provider. Identity verification may be required as part of the checkout process. No additional fees are charged for using the payment link.

Short stays (45 nights or fewer) must be paid in full before check-in.

Extended stays (46 nights or more) will be charged on a monthly basis. Each monthly payment is due between 3 to 5 days before the applicable due date. Late payments may result in reservation termination and a 5% monthly late payment fee.

Security Deposit: A security deposit may be required by the host prior to check-in. The deposit amount will be communicated clearly before booking confirmation and will be returned within 7 to 10 business days following departure, provided no damages or outstanding charges are incurred.

Guests agree to pay the rental price for the full duration of the reservation and any additional charges for requested services. Any outstanding balances may be charged to the payment method on file without prior notice unless alternative arrangements have been made in writing.

By confirming a reservation on MontrealStays, guests and hosts acknowledge and accept the following:

  • Platform Liability: MontrealStays is a marketplace platform connecting guests and hosts. We are not a party to the rental agreement between guests and hosts and are not liable for the condition, safety, legality, or suitability of any listed property.
  • Guest Indemnification: Guests agree to indemnify and hold harmless MontrealStays, its officers, employees, agents, and contractors from any loss, injury, damage, cost, action, or cause of action resulting from the actions of the guest(s), permitted occupants, or any individuals invited by the guest during the stay.
  • Lost, Damaged, or Stolen Items: MontrealStays assumes no liability for any items lost, damaged, or stolen during a guest’s stay or after vacating the property, unless covered by a specific insurance arrangement disclosed at booking.
  • Release of Liability: Guests release MontrealStays from any liability for personal injury, death, or property damage that may occur during the guest’s use of the rental property, regardless of when or how such incidents occur.
  • Host Responsibility: Hosts are solely responsible for ensuring their listings are accurate, safe, and compliant with all applicable laws, building regulations, and municipal short-term rental requirements. MontrealStays is not liable for inaccurate or incomplete listing information provided by hosts.

We strongly recommend that all guests obtain appropriate travel or rental insurance prior to their stay.

To ensure a smooth transition between guests, please review our check-in and check-out policy:

  • Check-Out Time: Guests are required to vacate the property by 11:00 AM on their departure date. This allows hosts to prepare the property for the next arrival.
  • Check-In Time: Check-in is available from 4:00 PM on the arrival date. Early or late check-in requests are subject to host availability and may incur an additional fee. Please contact the host in advance to arrange.
  • Time Changes: Any changes to check-in or check-out times must be communicated to the host in advance and confirmed in writing through the MontrealStays platform.
  • Key Handover: Check-in instructions and key handover details will be provided by the host prior to arrival. Guests are responsible for returning all keys, access cards, parking passes, and remotes upon departure.
  • Late Check-Out Fee: Guests who fail to vacate the property by the agreed check-out time may be charged a fee equivalent to one full day’s rental at the applicable nightly rate.
  • Lost or Unreturned Keys: Lost or unreturned keys, access cards, or remotes may incur a replacement charge at the host’s discretion.

A mandatory exit cleaning fee may apply to bookings, as set by the host and displayed at checkout. Additional cleaning services during the stay may be requested and are subject to availability and additional fees. To request mid-stay cleaning, please contact the host directly through the platform.

Guests are expected to maintain the property in a clean and reasonable condition throughout their stay. Upon departure, the property should be left in the same condition as upon arrival. Any excessive mess, damage, or cleaning requirements beyond normal use may result in additional charges to the guest. Damages caused during the stay will be assessed and charged accordingly, either from the security deposit or directly.

Requests to modify check-in or check-out dates must be submitted in writing through the MontrealStays platform. Acceptance of changes is subject to availability and remains at the sole discretion of the host and MontrealStays. Changes to dates may be treated as a cancellation if the original booking cannot be modified.

Early check-out requests require a minimum of 30 days’ written notice. Early departures without sufficient notice may be subject to a cancellation fee.

For early termination of a reservation, rates may be adjusted based on the revised length of stay, and guests will be responsible for any applicable rate differences.

Reservation extensions must be requested with a minimum of 30 days’ notice and are subject to availability. Extensions requested with less than 30 days’ notice are subject to availability and will incur a $150 administrative fee and are not guaranteed.

All cancellation requests must be submitted in writing through the MontrealStays platform. Cancellation policies may vary by listing — please review the host’s individual cancellation policy carefully before confirming a booking.

Short stays (under 30 nights) are non-refundable unless the host’s listing policy explicitly states otherwise.

Stays of 30 nights or more:

  • Cancellations made 30 or more days before arrival are fully refundable.
  • Cancellations made within 30 days of arrival are subject to a one-month rental penalty.
  • For reservations of 30 nights or more, the first month’s payment must be made immediately upon booking to confirm the reservation. Subsequent months will be charged on a month-by-month basis.
  • A non-refundable administrative fee of $50.00 applies to all cancellations.
  • A no-show will be treated as a cancellation and subject to the applicable cancellation policy. Individual host policies or building-level policies may supersede the above in certain cases.

MontrealStays and/or the host reserve the right to terminate a reservation at any time on the grounds of:

  • Abusive, threatening, or disruptive behaviour toward the host, other guests, neighbours, or building staff
  • Damage to or mistreatment of the rental property or building common areas
  • Criminal activity on the premises
  • Violation of building rules, municipal regulations, or MontrealStays platform policies
  • Late or non-payment of rental fees

In cases of termination due to guest misconduct, no refund will be issued and MontrealStays is not obligated to arrange or locate alternative accommodation. The applicable notice period and any refund are at the sole discretion of MontrealStays.

If a payment is more than 10 days late and no written payment arrangement is in place, MontrealStays reserves the right to terminate the reservation immediately. The guest will not be permitted to continue occupying the property. MontrealStays reserves the right to pursue legal action and claim outstanding fees, late fees, and legal costs where applicable.

By confirming a reservation on MontrealStays, guests agree to comply with all applicable building rules, municipal regulations, and platform policies. MontrealStays reserves the right to relocate a guest to a comparable property without prior notice in exceptional circumstances.

Smoking All properties listed on MontrealStays are smoke-free unless explicitly stated otherwise in the listing. Smoking in a non-smoking property or in prohibited common areas will result in an automatic penalty of $500, in addition to any cleaning costs incurred.

Behaviour Guests are expected to behave in a manner that does not cause a disturbance to, or interfere with, the quiet enjoyment of other residents, neighbours, or building staff. Parties, loud gatherings, or excessive noise may result in immediate termination of the reservation.

Occupancy Only the number of guests registered at the time of booking are permitted to occupy the property. Unauthorized additional occupants are not permitted and may result in immediate termination without refund.

Guest Registration Guests must provide the names, ages, and contact information of all occupants at the time of booking. This is required to ensure guest safety and compliance with emergency procedures. Failure to provide accurate registration information may result in reservation termination without notice or refund.

Host Registration Hosts must provide accurate property information, valid contact details, and any documentation required by MontrealStays to verify their listing. Hosts are responsible for ensuring their property complies with all applicable Quebec short-term rental regulations, including CITQ (Corporation de l’industrie touristique du Québec) registration requirements where applicable.

Pet Registration Pets are only permitted in properties where the host has explicitly enabled pet-friendly stays. Not all properties on MontrealStays allow pets — please confirm with the host before booking. A maximum of 2 pets per rental unit is permitted unless otherwise stated. All pets must be registered before arrival.

Pet fees apply to all animals except registered service animals. Service animals must be declared with supporting documentation prior to arrival. Owners are fully responsible for any damages or disturbances caused by their pets. Violation of pet policies may result in immediate reservation termination and a fine of $500.00.

MontrealStays strives to maintain accuracy in all listing information, descriptions, photographs, and pricing displayed on the platform. However, MontrealStays cannot be held liable for errors or omissions that may arise, including inaccuracies in host-submitted content.

MontrealStays reserves the right to modify, update, or remove any content published on the site at any time, including rates, descriptions, and platform features. We offer no warranty or representation regarding the fitness or suitability of any property advertised on the platform.

By using MontrealStays, you agree to comply with these Terms and Conditions and any future updates. Continued use of the platform following any changes constitutes acceptance of the revised terms. These terms do not affect your statutory rights as a consumer.

MontrealStays reserves the right to update these Terms and Conditions at any time as may be required by the platform’s business policies.
